1. Acceptance of Terms

By creating an account or using NOW 1.1 ("the App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and NOW 1.1.

2. Description of Service

NOW 1.1 is a location-based notification and community engagement platform that allows users to share short messages ("Chatters" for Guest users, "Promotions" for Business users) with other users within a 10-mile radius of their current GPS location. The App provides features including user profiles, content rating, and business promotion tools.

3. User Accounts

You must create an account to use the App. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate information when creating your account. You must be at least 18 years of age to use this App. By creating an account, you represent that you meet this age requirement.

4. User Conduct

You agree not to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Upload explicit, sexually suggestive, or inappropriate profile images
• Impersonate any person or entity
• Spam, solicit, or send unsolicited messages
• Attempt to gain unauthorized access to other users' accounts
• Use the App for any illegal purpose
• Interfere with or disrupt the App or its servers
• Collect or store personal data about other users without their consent
• Use automated means to access the App

5. Content

You retain ownership of content you post on the App. However, by posting content, you grant NOW 1.1 a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App. Chatters are automatically deleted after 3 hours. Business Promotions are visible to guests for 4 hours and retained for the business owner for up to 20 days. Profile images are screened by AI-powered content moderation to prevent inappropriate uploads. We reserve the right to remove any content that violates these Terms.

6. Location Data

The App requires access to your device's GPS location to provide location-based services. By using the App, you consent to the collection and use of your location data. Location data is used to display nearby content and deliver relevant notifications. You can revoke location permissions at any time through your device settings, though this will limit App functionality.

7. Privacy Policy

Your privacy is important to us. We collect and process the following information:

• Account information (username, encrypted password, account type)
• Profile information (headshot/avatar, story text, business details)
• Location data (GPS coordinates for content delivery)
• Usage data (ratings, replies, blocks)
• Device information (push notification tokens)

We do not sell your personal information to third parties. Data is stored securely and used solely for providing and improving the App's services. You may request deletion of your account and associated data by contacting us.

We do not collect or store home addresses. Proximity is determined entirely from your device's live GPS coordinates at the moment you make a request, and those coordinates are used only to deliver content and discarded after the request.

How we protect your chats:

• Encryption in transit. All traffic between your device and our servers is protected by HTTPS/TLS, so no one on your network or in transit can read your messages.
• Encryption at rest. Chat message contents are encrypted in our database using a symmetric key held only by our servers. If our database were ever compromised, the raw stored messages would be unreadable without the key.
• This is NOT end-to-end encryption. Because we operate moderation and safety features (reporting, banning, content review when chats are flagged), our servers can decrypt chat content when necessary. Authorized administrators may view the content of chats that have been reported. End-to-end encrypted apps (like Signal) cannot offer these moderation features; we have intentionally chosen safety and accountability over that stricter model.
• Push-notification previews. Notification text (e.g. message previews) is sent to Apple/Google push services to deliver to your device. By using the app, you accept that those providers handle this delivery on our behalf.

If you want a chat conversation to be private from everyone including us, do not send sensitive content (financial details, health information, etc.) through NOW 1.1 chat.

8. Blocking and Reporting

Users may block other users to prevent seeing their content. Blocked users will not be notified. Guest accounts inactive for 30 consecutive days may be automatically deleted. We reserve the right to suspend or terminate accounts that violate these Terms.

9. Business Accounts

Business users may create promotional content visible to nearby Guest users. Business accounts have access to profile features including logo, address, and phone number display. Business users are responsible for ensuring their promotional content complies with applicable advertising laws and regulations.

10. Intellectual Property

The App, including its design, features, and technology, is the property of NOW 1.1 and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure. We are not responsible for the accuracy, reliability, or completeness of any user-generated content.

12. Limitation of Liability

To the maximum extent permitted by law, NOW 1.1 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless NOW 1.1, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify users of significant changes through the App.

15. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the App ceases immediately.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration.
